Health Net has in agreement to pay $26 million in restitution and interest and $15 million in fines and other charges to settle allegations that it underpaid out-of-network claims for 88,000 New Jersey members between 1996 and 2005, the New Jersey Department of Banking and Insurance announced Tuesday, the Bergen Record reports. The $26 million payment is in addition to the more than than $800,000 that the insurance company agreed to pay in 2002 to more than 4,700 state customers for similar underpayments.
As part of the settlement, Health Net volition pay the affected members $14 million in add up underpaid claims, with an additional $12 million in interest, for out-of network medical services from 1996 through 2005 and dental, mental health and chiropractic services from 1999 through 2006. The settlement also includes $13 million in state fines and charges (Newman, Bergen Record, 8/27). In addition, the penalties include $2 million to cover the cost of the state's 21-month investigation (Bloomberg/Philadelphia Inquirer, 8/27). The reimbursement and penalties concord is the largest e'er administered by the department, department spokesperson Paul Penna said.
Alice Ferreira, a spokesperson for Health Net, said, "There were out-of-network claims that were not paid accurately," adding that the company has modified its reimbursement calculation system. Ferreira aforementioned that more than 55,000 reimbursement checks ranging from "a few dollars to several thousand dollars" already own been mail-clad out in the utmost two months and that most of the 88,000 members affected bear been contacted (Bergen Record, 8/27).

SAG Members Divided Over Strike Talks
Screen Actors Guild President Alan Rosenberg has expressed frustration over dissension within his union over bargaining strategy with the Alliance of Motion Picture and Television Producers. In an interview with Broadcasting & Cable, Rosenberg said that he wished the members of his union stood behind their negotiators the way the members of the Writers Guild of America did theirs. The WGA, he said, "didn't get the kind of resistance from their members that we get from ours." The dissension, he indicated, is the reason that the union leadership has not called for a strike authorization vote -- despite the fact that the current contract with the AMPTP expires in two weeks. Asked when he might decided to ask SAG members to authorize a strike, Rosenberg replied, "I really don't know. ... It depends on our assessment of whether we can get it or not. I think we'd get it." In fact, the AMPTP noted Friday that if a contract is not locked in by June 30, the current "de facto strike" will simply be extended with TV and movie producers delaying production on new films and television shows until an agreement is reached.

Dunst depressed or chemically dependant?
An insider has revealed that Cirque Lodge doesn�t treat patients suffering from depression alone, casting doubts on actress Kirsten Dunst having claimed she went there to seek treatment for the condition, starmagazine.com reports.
Dunst had also denied she was being treated for a drug or alcohol problem.
�I went there for depression ... I was struggling, and I had the opportunity to go somewhere and take care of myself,� Dunst said.
According to the insider, however, patients at the Sundance, Utah, facility, must have some kind of chemical dependency.
�They would refer you somewhere else if it�s just depression,� the insider explained.
